Index of 20 cities flattens in March

A closely watched index of home prices in 20 major cities flattened in March, with 10 cities posting declines, data released Tuesday showed.
The city of Los Angeles fell 0.3% in March over February. But San Diego gained 1.5% and San Francisco was up 0.9%, according to the Standard & Poor's/Case-Shiller index.
Eight cities posted gains while two cities, Miami and Tampa, Fla., registered no change. The flat 20-city reading came after the index posted a drop in February, its first decline since home prices began their most recent rise in June.
“The housing market may be in better shape than this time last year, but, when you look at recent trends there are signs of some renewed weakening in home prices,” said David M. Blitzer, chairman of the Index Committee at Standard & Poor’s. “In the past several months we have seen some relatively weak reports across many of the markets we cover.”
A separate Case-Shiller index that is released quarterly and covers the U.S. showed home prices fell a seasonally adjusted 1.3% in the first quarter of the year compared to the fourth quarter of 2009.
Smoking ban approved in SLO
The San Luis Obispo City Council on Tuesday voted 4-1 to give its final approval to a ban on smoking in nearly all areas open to the public.
Under the new law, which passed 4-1 on April 6, smoking is prohibited in indoor and outdoor areas frequented by the public, including sidewalks, parking garages, bars, restaurants, stores, stadiums, playgrounds and transit centers. It becomes effective May 20.
The citywide ban puts San Luis Obispo in the same class with two dozen other California cities that have banned smoking from all areas frequented by the public, including multi-unit residential areas.
Although San Luis Obispo’s ordinance does not ban smoking in private residences or apartments, it prohibits smoking in common areas of multi-unit residential complexes.
In December, the council voted to ban smoking in Mission Plaza, the downtown creek area and the city’s parks. Council members also directed staff to return in a few months with a comprehensive plan.
Twenty years ago, San Luis Obispo became the first city in the nation to ban indoor smoking in public places.
Police will not actively enforce the smoking ban but may issue citations for violations.

Most specifics on the special auditorium planned for one of the theater’s 10 screens aren’t finalized yet, but patrons will pay a surcharge per ticket at the box office to get in.
“We do find the VIP area is quite popular,” said Frank Rimkus, Galaxy Theatres’ chairman and chief executive officer. “But every market has their own sensitivities, so we want to match it to what the community wants.”
Rimkus plans to visit Atascadero this month to work with community leaders to determine what specific VIP elements fit with the North County.
Auditorium capacity, food service and the possibility of a lounge with tables are among the details for those talks, he said.
The Sherman Oaks-based company has its first and only VIP screen format operating in Gig Harbor, Wash., with several other sites in the works.
What’s certain so far in Atascadero is that admission tickets to the VIP screen would be first come, first served, Rimkus said, and available to individuals and private parties.
Guests will walk through the main theater lobby to get to the screen room, which is to have its own lobby, personal servers and an attendee to check identification cards to verify everyone is age 21 and older.
Beer and wine will be served by the glass, Rimkus said, with a focus on local offerings.
Galaxy Theatres’ application for a liquor license for the sale of beer and wine is now pending with the state.
The special screen will also show first-run movies, Rimkus said, ranging from action, to comedies to dramas.
“When ‘Sex and the City’ was on we showed it in a VIP auditorium and made it a fun event,” Rimkus said.
VIP admission tickets in Gig Harbor range from $13 to $15 per person, according to Galaxy’s website, while its regular screens ranged from $7.75 to $10 for adults.
Rimkus emphasized that every market is different, though, and that prices in one place may not reflect the prices in another.

Osos child care center gets grant
The Program for Infant and Toddler Care has awarded the Los Osos Early Care and Education Center $24,000 for equipment, mentorship, and 18 months of advanced training in infant and toddler care.
The center’s 10 care providers are participating in the training, which is funded through the state Department of Education and developed through a collaboration between the agency and the education research nonprofit group WestEd.
Founded in 2008, Los Osos Early Care and Education Center serves 50 children ages six months to six years. The center had to apply for the funding and is the only organization in San Luis Obispo County to receive it so far.

A VIP auditorium reserved for moviegoers age 21 and older will feature plusher seats and alcohol sales as part of Atascadero’s new Galaxy Theatres now being built in the long-awaited Colony Square project downtown.
Most specifics on the special auditorium planned for one of the theater’s 10 screens aren’t finalized yet, but patrons will pay a surcharge per ticket at the box office to get in.
“We do find the VIP area is quite popular,” said Frank Rimkus, Galaxy Theatres’ chairman and chief executive officer. “But every market has their own sensitivities, so we want to match it to what the community wants.”
Rimkus plans to visit Atascadero this month to work with community leaders to determine what specific VIP elements fit with the North County.
Auditorium capacity, food service and the possibility of a lounge with tables are among the details for those talks, he said.
The Sherman Oaks-based company has its first and only VIP screen format operating in Gig Harbor, Wash., with several other sites in the works.
What’s certain so far in Atascadero is that admission tickets to the VIP screen would be first come, first served, Rimkus said, and available to individuals and private parties.
Guests will walk through the main theater lobby to get to the screen room, which is to have its own lobby, personal servers and an attendee to check identification cards to verify everyone is age 21 and older.

real estate on the rise?
Amid other signs of recovery lands a new Gallup poll showing 72% of Americans think now is the time to buy a house, and the sooner the better because many of them expect house prices to begin to rise again. This consumer confidence in home value was up from 53% two years ago.
Whether people are simply reading the news reports, or reading the tea leaves, their optimism could boost home sales, the Gallup news release states, "to the degree that potential home buyers agree" with the advice.
Around the country, stories of upticks in buying have been on the rise. In today's Sacramento Bee, real estate reporter Jim Wasserman begins his piece: "It's spring, and homebuyers are back across much of the Sacramento region." The central strip of California known as the Central Valley was particularly hard hit by plummeting values and plummeting sales. But a new report Thursday by MDA DataQuick indicates spring is not the only factor, with year-over-year home sale gains in much of the Sacramento region.
Recent DataQuick analyses in other parts of the country showed glimmers of hope in home buying, although some of that can be attributed to people scooping up deals. As DataQuick's Andrew LePage told The Sacramento Bee: "There are more sellers who have just given up on waiting for prices to come back...Prices are soft and enticing some buyers."
The Gallup poll found American's exuding some confidence that home prices may be stabilizing, with 77% predicting they will stay the same or rise. That sense of price stability was greater on the East and West coasts and fell to a low of 65% in the South.
Noting this regional unevenness, Jim Gillespie, the president and CEO of Coldwell Banker, tells WalletPop that, "While prices may be stabilizing in many parts of the country, it is important to remember that real estate is local. However, reports such as this give us all continued optimism because housing plays such a critical role in our nation's economy."
The Gallup release ends with a dose of economic reality, referring to another of the group's recent polls about employment:
"While an overhang of foreclosures and distress sales continues to depress some areas, the basic problem facing housing in 2010-2011 is the same as that challenging the overall economy: jobs. ...For most Americans, it is hard to feel financially secure enough to make such a commitment in an economy in which 20% of the U.S. workforce is underemployed."

Biggest Real Estate Mistakes
1. Not Understanding the New Rules
What’s changed in real estate? The details. While you still go out and shop for a home, make an offer, find financing and close on the property, the details of how this process works today are vastly different from the way we went about buying real estate five, 10, or 20 years ago.
If you attempt to wade in without familiarizing yourself with the new way of doing business, you’ll find yourself blocked at almost every turn. Finding good partners (see below) can help, but you have to be prepared to provide more information and evaluate more factors in order to close successfully on a new home.
2. Failing to Build a Top Real Estate Team
If you buy and sell property for a living, you know that it’s a team sport. Even if you’re a real estate agent, you’ll still need a good lender, inspector, title or escrow company, and attorney to assist you in completing this purchase successfully.
But some buyers think they can do it on their own. In today’s new real estate world, that’s a mistake. For example, even in states where real estate attorneys aren’t generally used to close house deals, using an attorney to help you negotiate a foreclosure or short-sale purchase can mean the difference between closing and sitting in limbo. Real estate agents who intimately know the foreclosure market or have colleagues who represent real estate owned properties for banks and other financial institutions can help you find the right property faster. Get on their short list as an investor with cash to spend and they’ll give you extra time and attention.
Taking the time to build a great real estate team will pay off in spades. Not putting this team together ahead of time is a mistake you don’t want to make.
3. Not Responding to Your Lender’s Requests
Lenders have tightened up credit requirements and are taking the time to verify every piece of information you submit. In fact, when you apply for a mortgage today, you should expect to provide reams of documentation both with your application and during the verification process.
It’s quite likely that some of your information will disappear during the process, and you’ll be asked to replace various documents or augment your documentation. When these requests come in, you should take them seriously and respond quickly. If you don’t, you could be putting your financing in jeopardy.
4. Not Cleaning Up Your Credit in Advance
One of the ways lenders are tightening credit requirements is by raising the minimum credit score necessary to be approved for a mortgage. Prior to the credit crisis, lenders might have charged one interest rate if you had a 680 credit score — today you might need a credit score of 720 to get the same rate. When it comes to government-backed loans, FHA originally didn’t have a minimum acceptable credit score limit, but it has now instituted tougher standards that require a credit score floor of at least 600 in order to get a loan.
That’s why is extremely important that you spend time cleaning up your credit history and score before you apply for a loan.
5. Paying Too Much
Although home buyers are enjoying the strongest buyers’ market in recent memory, some buyers are paying more than they should for properties. Why? There seems to be a fear growing in some areas of the country that if you don’t buy now, you’ll miss out on a once-in-a-lifetime opportunity to “get in at the bottom.”
While it’s true that in some markets, “bottom feeders” are coming in and swooping up properties by the dozen, fear is the wrong emotion to drive the real estate market. The housing bubble formed because too many folks were thinking about real estate as an investment and not about the other parts of the equation. They were afraid to wait, believing that property prices would go up at 8 to 10 percent per year.
We now know that property prices can tank as well as soar. The trick is to understand what the real value is in a neighborhood and not overpay for property. Don’t be pressured into making a move before you’re ready.
6. Believing What You Read and See on the Internet
Scam artists love the Internet, and there will always someone trying to scam you in some way, shape, or form. And when it comes to real estate, it’s even easier to get ensnared in someone’s web. But even if you don’t get scammed, it’s easy to get fooled by what you read or see on the Internet. If you shop for a home only on the Internet, and never go to see the property in person, you might be surprised to find that the house looks different, or the neighborhood is not as it was represented. Perhaps the property backs up to a dump or the train tracks that you didn’t notice when you did your Google search.
The smartest thing you can do is take everything you see on the Internet with a grain of salt — and then take the time to see the property in person.
7. Not Understanding the Risks with a Desperate Seller
The housing crisis has produced millions of foreclosures. But it has also spawned millions of homeowners who are “underwater” with their mortgages — that is, who owe more than their homes are worth — and are offering them for sale for less than the mortgage amount. There are some risks involved when you buy a home through one of these so-called “short sales”: The property might have years of deferred maintenance (because if you can’t afford your mortgage, you probably can’t afford to maintain your home either); there may be hidden liens lurking that will cause problems after the closing; and you may have to negotiate with several lenders, which could take months.
If you’re hoping for a big bargain from an underwater seller, you’ll need to be patient. And above all, you’ll need to realize that even if you’ve spent months negotiating a deal, it could fall apart overnight — and you’ll have to start all over again.
8. Forgetting to Buy Owner’s Title Insurance
When you purchase property, your lender will require you to buy a lender’s title insurance policy. But unless you also purchase an owner’s title insurance policy, only the lender will be made whole financially if something goes wrong. And there are so many things that can go wrong when it comes to title. Not only can a former owner pop out of the woodwork, but mechanics’ and tax liens can “magically” appear — especially if you’re buying a short sale. (See above.)
Don’t risk it. Order an owner’s title insurance policy when you order the lender’s policy. If you’re buying with cash, don’t forget to order your owner’s policy well in advance of the closing date.
9. Not Considering a HUD Home
At a “How to Profit from Foreclosures” event I held in Atlanta in October 2009, I learned that there were more than 4,000 HUD homes for sale. (A HUD home is simply a foreclosure that had FHA financing.) I learned that there are clever ways of searching for an agent who is more than just HUD-certified, but who really knows how to put in an offer on a HUD home. (You must have a HUD-certified agent put in your offers for HUD homes.) I learned that home buyers who plan to live in the house have a two-week advantage over real estate investors. And I learned that with FHA financing about 20 to 25 percent of all homes purchased, there will be plenty of HUD homes for sale over the next few years. There are thousands of HUD homes for sale across the country, in most neighborhoods. If you’re not thinking about buying HUD homes, you should.

A recent report places San Luis Obispo County third on the list when it comes to being the least affordable place to live in the United States. [SantaMariaTimes]
The study, conducted by the National Association of Home Builders, focuses on median incomes and median home prices during the fourth quarter of 2009.
According to the study, SLO County’s median home price during the fourth quarter of 2009 was $372,000. With an average county family income of $70,800, only 32.1 percent of the homes in San Luis Obispo County were affordable to county families during that time.
SLO County also received the honor of being the nation’s least affordable smaller metro housing market. Of the 277 metro markets evaluated in the study, only New York City and San Francisco were ranked less affordable than SLO.
Kokomo, Ind., with a median income of $61,800 a year and a median home price of $73,000, was rated the most affordable place to live in the country.
Turnaround for San Luis Obispo County home sales?
Despite lingering negative forces, buyers are returning, and several signs suggest the worst may finally be behind us
With favorable interest rates, a first-time homebuyer tax credit and local home prices lower than they have been since the start of the decade, some buyers looking for bargains are slowly returning to the market.
But real estate economists and others tuned in to the industry disagree on whether 2010 will be the year the housing market bounces back.
As the economy tries to climb out of recession, consumer confidence — while up in January for the third consecutive month — remains tentative, job losses continue and California’s budget mess is far from over. Any one of those factors, some experts say, could hinder a recovery.
“We’re not out of this yet,” said Keith Byrd, an agent with Century 21 Hometown Realty who tracks local real estate trends.
Latest performance
Sales picked up in January compared to the same month a year ago, according to DataQuick, a Southern California-based real estate information firm.
A total of 191 homes — including newly built, resale single-family detached and resale condominiums — sold in the county last month, a 29.1 percent increase from January 2009, when 148 sold.
January sales, however, dropped nearly 36 percent from December 2009.
Byrd noted that there were 195 homes in the county that were pending sales in January compared to 216 in January 2009. That’s a nearly 10 percent drop. For the first 15 days of February, however, the county had 124 pending sales, up from 104 during the same time period last year.
“If this month’s pace keeps up, pending sales activity will take a bump up from last February,’’ he said. “It’s all probably going to equal itself out, and we’ll track close to where we were last year.”
Still, Byrd said higher inventory levels (10 months’ worth in January, the highest level since May 2009), interest rates increasing and the federal first-time homebuyer tax credit expiring are unknowns that put the market in a fragile position. The $8,000 tax credit program applies to eligible buyers who enter into a contract to buy a principal residence on or before April 30 and close on the home by June 30.
An increasing number of foreclosures, he said, could also be a drag on the market. Last year, 2,603 notices of default, the first step in the foreclosure process, were filed, a nearly 39 percent increase from 2008, when 1,877 were recorded, according to data from All-American Foreclosure Service in San Luis Obispo.
A total of 1,088 trustee deeds, marking the final step when the property goes back to the lender, were recorded in 2009, a 14 percent increase from 2008, when 954 were recorded. By contrast, there were only 378 recorded in 2007 and 67 the prior year.
“The good news is we’ve been saved thus far from a big percentage like some other cities and counties have, but the amount we have is causing the values to go down — period,” Byrd said. “We’re almost down to 2002 levels in most cities. The question is, can it drop down much more?”
The all-home median price in January was $366,750, according to DataQuick, a 2.2 percent decrease from the $375,000 median price recorded in the same month a year ago. The all-home median in January fell nearly 6 percent from the December 2009 median, which stood at $390,000.
The median price for new homes in January was $352,500, a 7.2 decrease from $380,000 posted in the same month the previous year. It was also a 36 percent drop from the December 2009 median price of $556,600.
The median price of condos also dipped to $227,000 in January, a 9.6 percent drop from the $251,000 median price in January 2009. Last month’s median sales price was also 2.1 percent lower than the $232,000 recorded in December 2009.
Beacon Economics, the Los Angeles-based firm that presented the county’s 2010 outlook for the UC Santa Barbara Economic Forecast Project, predicted in November that the median home price is expected to drop an additional $45,000, or about 12 percent, by 2011.
Brad Kemp, director of regional research for Beacon, said that prices would then start to return to a reasonable and sustainable growth rate, unlike the
double-digit appreciation seen in the earlier part of the decade.
Turnaround year?
While some are taking a cautious approach, Mark Schniepp, economist with the California Economic Forecast in Goleta, is optimistic that the county’s housing market is headed for a rebound.
“There are pessimists out there, but we look for this to be a turnaround year,’’ he said. “This will be a much better year for more sales and price stability.”
Schniepp believes the economy will improve and jobs will slowly return this year, which means that consumers will feel more confident about buying property. The first-time homebuyer tax credit, he said, will most likely be extended.
He also said that any resurgence of foreclosures — as banks start releasing them — will not be enough “to derail the housing recovery.”
“We don’t think it’s going to cause a bigger problem for real estate,’’ Schniepp said. “It will work its way through. We see it as the final year of bad homeowner distress. Prices should move higher, and we should start to see more sales.”
The California Association of Realtors also forecasts median prices increasing modestly from the previous year and only a slight decline in sales.
The association forecasts that the median home price in California will rise 3.3 percent to $280,000 this year. That’s compared to a projected median of $271,000 in 2009. Sales are expected to decline 2.3 percent to 527,500 units, down from 540,000 projected in 2009.
Jim Liptak, a Paso Robles Realtor and past president of the association, believes the market has turned a corner. In the county, homes below $400,000 are generating a lot of activity, and anything over $500,000 is still sluggish, he said. There are three-bedroom, two-bath homes in Paso Robles selling for $250,000 or less.
“I think we have hit the bottom in the low end,’’ he said. “The question is how long do we bump along the bottom? You will see a gradual increase in both home sales and median price. But we’re not going to see the unhealthy environment of 2003, 2004 and 2005.”
While the county has not been insulated from the recession, in the longterm it is in a better position than other regions to weather the economic downturn, Liptak said. The unemployment rate continues to be lower than in other counties in the state, and the Central Coast is an attractive place to live, he said.
“Three to five years down the road, I’m very bullish on investment in real estate,’’ he said.
Despite his confident stance, Liptak recognizes that weaknesses remain.
“We will be in a market like this for the next couple of years,’’ he said. “There’s nothing that tells me that we’re going to have a rebound that’s really strong. There are so many economic sectors of the country that are in distress.”

Gov. Arnold Schwarzenegger lobbied Monday in San Luis Obispo for a set of bills he says will create more jobs by assisting California businesses in hiring and training qualified employees.
Schwarzenegger, joined by state Sen. Abel Maldonado, R-Santa Maria, who is Schwarzenegger’s nominee for lieutenant governor, toured REC Solar, a solar installation firm, before discussing the legislative package designed to create or preserve at least 100,000 jobs.
“Here is the perfect example of what is good for the economy and also good for the environment,” said Schwarzenegger, adding that his legislative package would help companies such as REC Solar expand throughout the state.

REC Solar CEO Angiolo Laviziano said that it was the governor’s vision on solar technology that encouraged him to bring his business to California in 2005. Since then, he said, the company has grown from 35 employees to almost 500.
Laviziano said the legislative package the governor announced Monday will help him continue to expand the business as he works to hire an additional 200 employees in the coming year. “The most important thing for us is to bring our economy back as quickly as possible,” Schwarzenegger said.
Dubbed the California Jobs Initiative, the package of five bills to be put before lawmakers was previewed in Schwarzenegger’s Jan. 6 State of the State speech.
The plan’s main provisions call for a $3,000 reimbursement for employers who hire unemployed Californians, as well as reimbursement for the cost of job training for employees who were unemployed, underemployed or threatened with layoff.
“We want to put every Californian to work that is willing to work,” Schwarzenegger said.
Those two incentives are designed to save an employer up to the equivalent of what it would pay for an employee in state taxes in a year, according to an announcement from the governor’s office.
The program would also provide training for up to 140,000 individuals, intended to help them qualify for better jobs.
Mike Manchak, president and CEO of the Economic Vitality Corp. of San Luis Obispo County, said the proposed legislative package “is about making the state of California business-friendly — it is a bold move and a direction that the state needs to go. We need to support this because we will benefit from it.”
Manchak said that while it is impossible to know how much of a direct impact Schwarzenegger’s proposed bills will have on local businesses, it will help to recruit and maintain business in San Luis Obispo County.
“It is vital to help companies grow and expand and feel welcome here,” Manchak said. “If not, they will go elsewhere.”
Other provisions include an extension of the home-buyer tax credit, to encourage homeownership, and eliminating sales taxes on “green tech” manufacturing equipment as an incentive to boost investment in that part of the economy.
Another provision of the program would streamline projects that have already completed environmental impact reports, but that are delayed by lawsuits challenging those reports.
Schwarzenegger’s package also includes provisions that would change rules for class-action and product-liability lawsuits against businesses and seek a cap on punitive damage awards.
The program would be funded by a loan from the Unemployment Compensation Disability Fund, which currently has enough surplus to pay for it after covering claims, according to the governor’s office.
Maldonado said getting the bills approved by the Legislature will depend on the focus being put on the jobs it will create, not politics.
“As long as the focus remains on jobs, we are going to get this done,” he said. “If the focus is on other things, we won’t. It is time to work together and get this moving.”
